Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully. By downloading, installing, or using Lumen Grove (the "Game"), you agree to be bound by these Terms.

1. Definitions

Game: The Lumen Grove software application, including all related updates, patches, and in-game content, ads, and in-app purchases.
User: Any individual or entity that downloads, installs, accesses, or uses the Game.
User Content (UGC): Any text, images, audio, video, or other materials submitted by a User through the Game.
Personal Data: Any information relating to an identified or identifiable natural person.
API/SDK: Any application programming interfaces or software development kits provided by the developer.
Ads: Third-party advertisements served in the Game via ad networks.
In-App Purchases (IAP): Virtual goods, subscriptions, or other paid content offered within the Game.

2. Entire Agreement

These Terms, together with any end-user license agreement, privacy policy, or other legal notices published by the developer, constitute the entire agreement and supersede all prior agreements.

3. Eligibility and Use by Minors

Age Rating 3+: The Game is designed for children aged 3 and up.
Use by Minors (under 18): Installation and use by anyone under 18 years old is permitted only with the prior consent and under the direct supervision of a parent or legal guardian.
Use by Children under 3: Use by children under 3 years old is strongly discouraged and, if attempted, remains entirely at the risk of the supervising adult.
Parental Responsibility: Parents/legal guardians are responsible for monitoring playtime, enforcing appropriate device settings (e.g., screen time limits), and ensuring compliance with all local regulations regarding minors' use of software.

4. License Grant and Restrictions

4.1. License Grant

Subject to compliance, you have a limited, non-exclusive, non-transferable, revocable license to install and use the Game for personal, non-commercial purposes.

4.2. Prohibited Uses

You may not:

Decompile, reverse-engineer, disassemble, derive source code, or create derivative works.
Exploit bugs or use cheats, bots, hacks, or other unauthorized third-party software.
Rent, lease, sublicense, share, or otherwise transfer your license.
Use the Game or any API/SDK for any commercial, illegal, or sanction-evading purposes.

4.3. Limited Warranties

THE GAME IS PROVIDED "AS IS" WITH ALL FAULTS. NO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UPTIME, OR ERROR-FREE OPERATION ARE PROVIDED.

4.4. Export Control

You may not export, re-export, or transfer any Game component or SDK to countries or persons subject to trade restrictions or sanctions.

5. Intellectual Property

All rights, title, and interest in and to the Game (including graphics, audio, code, designs, ads integrations, and IAP assets) are owned or licensed by the developer. No rights are granted beyond those in these Terms.

Fair-use Backup: Users may create a single backup copy of the Game for personal use only.

6. User Content

6.1. Submission

Upload UGC only when expressly invited.

6.2. UGC License

By submitting UGC, you grant the developer a perpetual, irrevocable, royalty-free license to use, reproduce, modify, distribute, display, and create derivative works solely for operation, promotion, and improvement of the Game.

6.3. Moderation

We may review, refuse, remove, or modify any UGC at our discretion.

6.4. Vulnerability Disclosure

You agree to report any security vulnerabilities privately to info@points.gs and refrain from public disclosure without consent.

7. Account Suspension and Termination

We may suspend or terminate your access for violations, interference with others, or fraudulent behavior. Notice will be provided, and you have 14 days to cure before permanent termination.

Appeals Procedure: Submit appeals within 14 days via info@points.gs; we aim to respond within 90 days.

8. Ads and In-App Purchases

8.1. Ads Integration

The Game displays third-party advertisements. The developer:

Is not responsible for ad content, accuracy, or any actions resulting from ads.
May modify, pause, or remove ads at any time without notice.
Uses ad networks that may collect non-identifiable usage data; see Privacy Policy.

8.2. In-App Purchases

The Game offers IAP for virtual goods and subscriptions:

All IAP transactions are final and non-refundable except as required by law or store policy.
The developer reserves the right to change prices, content, and availability of IAP at any time.
Subscriptions auto-renew unless cancelled in the store settings; Users are responsible for managing renewals.
Access to subscription features may be modified, suspended, or terminated by the developer at any time.

9. Indemnification

You agree to indemnify, defend, and hold harmless the developer, affiliates, and licensors from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your use of the Game, including any claims related to ads or IAP.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Cap on Damages: The developer's aggregate liability under or in connection with these Terms shall not exceed €0 per User.
Exclusion of Consequential Damages: NO INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR REVENUE.
Time-Bar on Claims: All disputes or claims must be brought within 12 months from the date they arose; any claim filed thereafter is waived.
No Class Actions: Users waive any right to join or bring class actions or collective arbitrations.

11. Insurance Recommendation

Users are advised to obtain their own cyber, liability, and professional insurance to cover potential losses related to use of the Game.

12. API/SDK and Third-Party Services

12.1. API/SDK Terms

Use of any API/SDK is subject to separate license terms, rate limits, quotas, and support policies. Unauthorized use or distribution of SDK code is prohibited.

12.2. Third-Party Ads and Services

The developer makes no warranties regarding third-party ad networks, analytics, or other services. Integrations may be modified or terminated at any time without liability.

13. Automatic Updates and Disabling

Critical security patches and updates may be installed automatically without prior notice. The developer is not liable for any results of such updates or for disabling non-compliant or outdated versions to maintain security and integrity.

13a. Security Measures and Disclaimer

The developer employs reasonable commercial efforts to maintain the security and integrity of the Game, including implementing industry-standard security practices, regular vulnerability patches, and monitoring for threats. However, the Game is provided without any warranty of absolute security or freedom from vulnerabilities.

The developer shall not be liable for any damages, losses, or liabilities resulting from unauthorized access, breaches, or cyberattacks by third parties, provided that the developer has implemented and maintained reasonable security measures.

14. Force Majeure

The developer is not liable for delays or failures due to events beyond our control, including natural disasters, war, labor disputes, government actions, sanctions, third-party service failures, or infrastructure outages. Obligations resume promptly after the event ends.

15. Governing Law and Dispute Resolution

These Terms are governed by Estonian law. All disputes shall be resolved exclusively in the courts of Estonia; international arbitration and foreign courts are excluded.

16. Assignment and Affiliates

The developer may assign rights or delegate obligations under these Terms to affiliates or successors without your consent. These Terms apply to such successors and assigns.

17. Modification of Terms

We may update these Terms at any time by posting a revised version in-game or on the official website. Changes take effect 30 days after posting. Continued use after that date constitutes acceptance.

18. Severability and Waiver

If any provision is invalid or unenforceable, remaining provisions remain in full force. Waiving a breach does not waive any subsequent breach.
