Terms and Conditions

Please read these Terms carefully. By downloading, installing, or using Lumen Grove (the "Game"), you agree to be bound by these Terms. If you do not agree, do not install or use the Game.

1. Developer

The Game is developed and published by Bogdan Kagitin, an individual developer based in Estonia.

2. Definitions

• Game — The Lumen Grove mobile application, including all updates and downloadable content
• User — Any person who downloads, installs, or uses the Game
• IAP — One-time in-app purchases of virtual goods offered within the Game
• Ads — Third-party advertisements displayed in the Game
• SDK — Third-party software development kits integrated into the Game

3. Eligibility and Use by Minors

• The Game requires users to be 13 years of age or older. At first launch, users must confirm they meet this requirement before accessing the Game
• Users under 13 may not use the Game. If we become aware that a user is under 13, we will delete any associated data and restrict access
• Users aged 13–17 must have prior consent from a parent or legal guardian, who accepts these Terms on the minor's behalf
• Parents and guardians are responsible for monitoring usage and managing IAP and screen-time settings on the child's device

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Game on your personal device for personal, non-commercial purposes only.

You may not:

• Decompile, reverse-engineer, or disassemble the Game
• Use cheats, bots, hacks, or unauthorised software
• Redistribute, sell, or sublicense the Game
• Use the Game for any unlawful purpose

5. Intellectual Property

All content in the Game — graphics, audio, code, and design — is owned by or licensed to the developer. No intellectual property rights are transferred to you under these Terms.

6. In-App Purchases

• The Game offers one-time purchases of virtual goods, processed exclusively by Google Play
• The developer does not directly receive payments from users and is not a party to any financial transaction between a user and Google Play
• All refund requests must be submitted to Google Play in accordance with Google's refund policy
• Virtual goods have no real-world monetary value and cannot be transferred or redeemed outside the Game
• The developer reserves the right to modify or remove IAP content at any time

7. Advertisements

The Game displays third-party advertisements through Google AdMob (Google LLC). The developer:

• Is not responsible for ad content or any outcomes resulting from ads
• Configures ads in compliance with applicable child-directed advertising regulations
• May modify or remove ads at any time without notice

Ad networks may collect non-identifiable data as described in our Privacy Policy.

8. Anonymous Authentication

At first launch, the Game assigns an anonymous identifier to your installation. This identifier is not linked to your name, email, or payment information and is used solely to save and restore your game progress. Uninstalling the Game may permanently delete your progress.

9. Third-Party Services

The Game integrates the following third-party services:

Unity services are governed by Unity Technologies' Terms of Service: unity.com/legal/terms-of-service.
Google AdMob is governed by Google's Terms of Service: policies.google.com/terms.
Tenjin SDK is governed by Tenjin's Terms of Service: tenjin.com/terms.
The developer is not responsible for the data practices or service availability of these third parties.

10. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law:

• We disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and error-free operation
• All purchases are processed by Google Play. The developer does not directly receive payments from users and is not a party to any financial transaction between a user and Google Play. Financial claims relating to purchases must be directed to Google Play
• We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Game
• Our total aggregate liability for any non-financial claims arising from your use of the Game shall not exceed the maximum amount permitted under applicable mandatory law

Nothing in these Terms limits or excludes liability that cannot be excluded under mandatory applicable law, including Estonian consumer protection law and EU consumer rights directives.

11. Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Game.

12. Updates and Maintenance

We may update, modify, or discontinue the Game at any time. Critical security updates may be applied automatically. We are not liable for any impact such changes may have on your experience or saved progress.

13. Governing Law and Disputes

These Terms are governed by the laws of Estonia. Disputes shall be resolved in the competent courts of Estonia. Nothing in these Terms prevents you from exercising statutory consumer rights under applicable EU or Estonian law.

14. Modifications

We may update these Terms at any time. Changes take effect 30 days after posting in-game or on the official website. Continued use of the Game after that date constitutes acceptance.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.
